1. Foster, age 18 at the time of trial, was indicted for armed robbery, convicted as a party to an offense and sentenced to serve a term of 10 years. Code § 26-902. At trial he made no objection to the introduction of his statement. He objected to the introduction of the pistol and being searched, and stated that he had not given the statement voluntarily, but did not object on the ground that he was not fully informed of his rights under Miranda v. Arizona, 384 U. S. 436. During the trial he made no objection as to the form of the charge, the evidence, or the constitutionality of the statute under which he was convicted. He enumerates error in the denial of his motion to suppress and in his sentence on the ground that he was a juvenile at the time of the commission of the crime.
There is no enumeration of error complaining of the form of the charge. The sentence is without merit as it is within the limits of the statute. (Code § 26-303), and is not illegal as to a juvenile under Code § 26-301 (b) since the crime was committed prior to the enactment of that act.
2. In three enumerations of error Foster objects to the allowing of the gun in evidence. The pistol was found in the back of the car in which appellant and the two older men were riding at the time of the robbery. Carl Petrich, 66, of Dallas, Texas, and Randy Lee Franklin, 53, of New Haven, Connecticut, were charged in a criminal complaint with one count of conspiracy to commit theft, one count of theft of government funds, and one count of tampering with government records. Franklin, who is also a defendant in an unrelated case, has pleaded guilty and awaits sentencing. Petrich has not yet entered a plea.
If convicted of the charges in the complaint, the defendants face a maximum potential penalty of 25 years in prison for the conspiracy count; 15 years in prison for theft of government funds; and 10 years in prison for tampering with government records. The defendants also face a maximum fine of $250,000.
“The Justice Department will not tolerate the theft of government funds and will aggressively prosecute those who steal from the American taxpayers,” said Assistant Attorney General Benczkowski. “This defendant not only cheated the United States and stole from the people, he also violated the sacred trust that we place in our public servants and their employees.”
